Welcome to Fresco. These Terms & Conditions ("Terms") govern your use of the Fresco website, mobile application, and related services operated by Fresco App LLC ("Fresco," "we," "our," or "us").

By accessing or using Fresco, you agree to these Terms.

1. Description of Service

Fresco provides a platform that allows users to discover, browse, reserve, and attend fitness, wellness, educational, and community events hosted by independent instructors, studios, businesses, and organizations.

Fresco does not own, operate, manage, or supervise classes listed on the platform.

2. User Eligibility

You must be at least 18 years old to create an account.

Users under 18 may only participate with permission from a parent or legal guardian.

3. User Accounts

You agree to:

  • Provide accurate information.

  • Maintain the security of your account.

  • Keep login credentials confidential.

  • Notify Fresco immediately of unauthorized account activity.

You are responsible for all activity conducted through your account.

4. Class Reservations

Fresco allows users to reserve spots in classes and events.

Reservations may be subject to:

  • Capacity limits

  • Waitlists

  • Attendance requirements

  • Host-specific rules

Hosts may modify, cancel, postpone, or reschedule events at any time.

Fresco is not responsible for losses resulting from event changes.

5. Attendance Deposits and Fees

Some classes may require a refundable reservation deposit.

When applicable:

  • The deposit amount will be displayed before booking.

  • Deposits may be refunded according to the host's attendance policy.

  • Failure to attend may result in forfeiture of the deposit.

Fresco processes payments on behalf of hosts but does not guarantee refunds beyond the published policies.

6. Health and Safety Disclaimer

Participation in fitness, wellness, recreational, or educational activities involves inherent risks.

By attending any event listed on Fresco, you acknowledge and agree that:

  • You participate voluntarily.

  • You assume all risks associated with participation.

  • You are responsible for determining whether you are physically able to participate.

Consult a healthcare professional before beginning any exercise program.

7. Host Responsibility

Event hosts are solely responsible for:

  • Event content

  • Instructor qualifications

  • Safety procedures

  • Facility conditions

  • Compliance with applicable laws

Fresco does not verify every host, instructor, or venue.

8. Prohibited Conduct

Users may not:

  • Use the platform for unlawful purposes.

  • Harass or threaten others.

  • Submit false information.

  • Interfere with platform operations.

  • Attempt unauthorized access to accounts or systems.

  • Upload malicious software or content.

Violation may result in account suspension or termination.

9. Intellectual Property

All content, trademarks, logos, designs, software, and materials associated with Fresco are owned by Fresco App LLC or its licensors.

Users may not copy, distribute, modify, or reproduce platform content without written permission.

10. User Content

Users may submit:

  • Reviews

  • Comments

  • Photos

  • Event feedback

By submitting content, you grant Fresco a non-exclusive, worldwide, royalty-free license to use, display, and promote such content.

You remain the owner of your content.

11. Limitation of Liability

To the fullest extent permitted by law, Fresco App LLC shall not be liable for:

  • Injuries sustained during events

  • Event cancellations

  • Host misconduct

  • Property damage

  • Lost profits

  • Indirect or consequential damages

Use of the platform is at your own risk.

12. Indemnification

You agree to defend, indemnify, and hold harmless Fresco App LLC and its affiliates from claims arising out of:

  • Your use of the platform

  • Your attendance at events

  • Your violation of these Terms

13. Termination

Fresco may suspend or terminate accounts at any time for violations of these Terms or conduct deemed harmful to the platform or community.

14. Changes to Terms

We may update these Terms periodically.

Continued use of Fresco after updates constitutes acceptance of the revised Terms.
